We make every effort to display the colors, descriptions, formulations, and specifications of our physical products (including turf nutrients, soil amendments, and application equipment) accurately. We do not warrant that product descriptions or other content are entirely error-free, complete, or current.

Agronomic and Application Disclaimer

Any agronomic advice, product application rates, soil/tissue test interpretation guidance, or turf management recommendations provided on the Site or via our communications are offered for general informational purposes only. Results may vary widely based on local environmental factors, climate, application timing, equipment calibration, and specific turfgrass species or soil chemistry. It is your responsibility to test formulations in controlled test areas and follow all local, state, and federal environmental and agricultural application guidelines.

Availability and Orders

We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction, and to limit the quantities of any products or services offered. All orders are subject to acceptance and verification.

3. Digital Products, 3D Models, and CAD Files

If our Site offers digital files (such as 3D printable files [STL, 3MF, STEP], equipment diagrams, CAD designs, or software guides):

License Grant

Unless explicitly stated otherwise, the purchase or download of digital files grants you a non-exclusive, non-transferable, revocable license for personal or internal business use only.

Restrictions

You may not redistribute, resell, sub-license, host, or share original digital files or modified versions thereof on public repositories or print-on-demand marketplaces without express written permission from the Company.

Tolerances and Calibration

We do not guarantee that all components print or are manufactured precisely the same, although all products perform at or above specifications as designed.

4. Communications and FCC / TCPA Compliance

Transactional Communications

By creating an account, placing an order, or submitting a service request, you agree that we may contact you via email, telephone, or mail regarding your order status, account activity, and administrative updates.

Marketing Communications & Prior Express Written Consent

Where you have submitted an affirmative opt-in (e.g., checking an unchecked box on a checkout or contact form), you provide your prior express written consent for PURE Insight and its authorized vendors to deliver automated marketing, promotional, and informational messages—including SMS/MMS text messages and calls delivered using automated technology—to the telephone number you provided.

Non-Condition of Purchase

You acknowledge and understand that consent to receive marketing text messages or calls is not a condition of purchasing any goods or services from the Company.

Message Rates and Frequency

Standard message and data rates may apply as determined by your mobile carrier. Message frequency varies based on your preferences and site interactions.

Opt-Out & Help Procedures

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PURE INSIGHT, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, CROPS, TURF QUALITY, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE, ITS DIGITAL FILES, OR ITS PHYSICAL PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO THE COMPANY IN THE PRECEDING SIX (6) MONTHS, OR $100.00, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless PURE Insight™, its affiliates, and their respective officers, members, and employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your improper use or misapplication of physical products, or your use of digital files downloaded from the Site.

11. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to your use of the Site shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any choice or conflict of law provision.

Any legal action, suit, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the federal or state courts located in Montgomery County, Pennsylvania (or the United States District Court for the Eastern District of Pennsylvania), and each party irrevocably submits to the personal jurisdiction of such courts.

12. Modifications to the Terms

We reserve the right to revise and update these Terms at any time at our sole discretion. All changes are effective immediately upon posting to the Site. The “Last Updated” date at the top of this document indicates when revisions were made. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
